A Legal Disclaimer

These Terms & Conditions apply to all estimates, quotes, invoices, and services provided by Think Pink Trees. By requesting an estimate, approving work, signing, paying a deposit, or allowing work to begin on site, the Client agrees to these Terms & Conditions. If any portion of these Terms & Conditions is determined to be unenforceable, the remaining sections will continue in full force and effect.

These Terms & Conditions (“Terms”) apply to the use of this website and to all estimates, quotes, invoices, and services provided by Think Pink Trees (“Company,” “we,” “us”). By accessing this website, submitting a form, requesting an estimate, approving work, paying a deposit, signing an estimate, or allowing work to begin at the job site, you (“Client,” “Customer,” “you”) agree to these Terms. If any portion of these Terms is determined to be unenforceable, the remaining sections will continue in full force and effect.

1) Website Use

This website is provided for general informational purposes and to allow visitors to contact Think Pink Trees and request estimates or services. We may update, modify, or remove website content at any time without notice.

2) Estimates & Quote Validity

  • All estimates are valid for 7 calendar days from the date issued unless otherwise stated in writing.

  • Prices are based on visible site conditions and the scope described at the time of estimate.

  • Estimates may change due to additional hazards, access issues, changes in scope, storm demand, or any conditions not reasonably known at the time of estimate.

Submitting a form or requesting an estimate does not guarantee availability or scheduling.

3) Authorization to Perform Work

Work may be authorized by any of the following:

  • written approval (signature, email, or text confirmation)

  • payment of a deposit

  • verbal authorization confirmed by Company

  • granting access to begin work on site

By authorizing work, Client confirms they have authority to approve services at the property.

4) Scope of Work

Only the work specifically written on the approved estimate or invoice is included.

Unless expressly stated in writing, the following are not included:

  • stump grinding / stump removal

  • root removal

  • landscaping restoration (sod, mulch, stone, edging, etc.)

  • irrigation repair

  • fence repair

  • driveway/paver restoration

  • hauling of debris not generated by Company’s work

  • roof/screen enclosure/gutter repair

  • utility line clearance or work requiring utility authorization

If additional work is requested or becomes necessary, a change order (additional charge) may apply.

5) Hidden Conditions / Tree Risk Acknowledgment

Client understands tree work involves inherent risk. Many conditions cannot be detected until work begins, including but not limited to:

  • internal decay / rot / hollow trunks

  • termite or insect damage

  • unstable trees or root plates

  • saturated soil, sinkholes, shifting ground

  • buried debris, old concrete, rebar, roots, unknown obstacles

These conditions may require changes to method, equipment, time, manpower, and pricing.

6) Property Conditions & Underground Items

Client is responsible for identifying and/or marking private property hazards and underground items including:

  • irrigation lines and sprinkler heads

  • septic systems and drain fields

  • wiring, lighting cables, pet fences

  • water lines and private drainage systems

  • hidden concrete, pavers, or shallow foundations

Think Pink Trees is not responsible for damage to unmarked or unknown underground items.

7) Site Protection / Cleanliness Standards

We take reasonable precautions to protect the property and leave a clean site. However, Client acknowledges that tree and storm work may involve:

  • equipment travel over grass and soil

  • dragging/lowering debris

  • use of heavy machinery, mats, rigging, or cranes

  • temporary debris staging

Minor turf disturbance, ruts, soil displacement, or scuffing may occur, especially in wet conditions. Landscaping restoration services are only included if quoted in writing.

8) Access, Safety, and Work Area Requirements

Client agrees to ensure:

  • clear access to the work area

  • vehicles moved from the work zone

  • gates unlocked or access code provided

  • pets secured indoors or away from work area

  • children kept away from work zone

  • HOA/community approvals obtained where needed

If we cannot safely access the area or complete work due to access limitations, a trip fee / standby fee / rescheduling feemay apply.

9) Weather, Safety Stops, and Rescheduling

Tree and storm work is weather-dependent. For safety, Think Pink Trees may delay, stop, or reschedule work due to:

  • lightning or storms

  • high winds

  • extreme rain/saturation

  • unsafe conditions on site

Scheduling delays caused by weather or storm demand do not entitle Client to refunds, penalties, or damages.

10) Emergency / Storm Response Work

Emergency work includes storm-related hazards such as fallen trees, blocked driveways/roads, hanging limbs, and hazardous removals.

Client acknowledges:

  • Emergency work is prioritized based on safety, access, and dispatch capacity.

  • Emergency pricing may differ from standard pricing due to hazard level, mobilization, after-hours work, and demand.

  • Storm debris conditions may require phased cleanup and staging.

11) Payment Terms

Unless otherwise agreed in writing:

  • Payment is due immediately upon completion of work.

  • Deposits may be required for large jobs, crane work, land clearing, or emergency mobilization.

  • Unpaid balances may be subject to late fees and/or collections as permitted by law.

For approved HOA/commercial accounts, payment terms (Net 15/Net 30) must be agreed to in writing.

12) Cancellations

Client cancellations may result in fees if:

  • crews have been dispatched

  • equipment has been mobilized

  • job time has been reserved

  • disposal arrangements were made

For large projects and crane work, cancellation may include mobilization costs.

13) Photos & Documentation

Client agrees Think Pink Trees may take photos/video:

  • for estimates

  • before/after documentation

  • job quality records

  • training and operational purposes

  • marketing and portfolio use

No personal identifying details will be intentionally shared. Client may request to opt out of public marketing use in writing.

14) No Guarantee of Specific Results

While we aim for high-quality results, Client acknowledges we cannot guarantee:

  • exact appearance outcomes of trimming (trees grow naturally)

  • future tree failure outside the contracted scope

  • prevention of all storm-related damage

  • regrowth or root activity

15) Limitation of Liability

To the maximum extent permitted by law:

  • Think Pink Trees is not liable for indirect, incidental, consequential, or special damages.

  • Liability for any claim related to services is limited to the amount paid by Client for the specific invoice at issue.

We are not responsible for pre-existing property issues or failures caused by hidden conditions, environmental factors, or acts of God.

16) Disputes & Notice

Client must notify Company of any concerns in writing within 48 hours of completion. Company must be given a reasonable opportunity to inspect and address issues before third-party repairs are performed.

17) Intellectual Property

All website content (logos, images, photos, text, designs) is the property of Think Pink Trees unless stated otherwise. You may not copy, reuse, reproduce, or distribute any materials without written permission.

18) Communications (Call/Text Consent)

If you submit your phone number through the website or by direct communication, you consent to receive calls and text messages from Think Pink Trees related to:

  • estimates and scheduling

  • job updates

  • invoices and payment coordination

  • service follow-ups

You may request to opt out of non-essential messages at any time.

19) Governing Law

These Terms are governed by the laws of the State of Florida. Any dispute shall be handled in a court of competent jurisdiction in Hillsborough County, Florida, unless otherwise required by law.
